§1 General provisions
  1. These terms and conditions set out the terms and conditions for the provision of electronic services via the website https://G4Skins.com, owned by OXMIS LTD, HE 467004, Markou Drakou, 69, Mesa Geitonia, 4002, Limassol, Cyprus.

  2. The user may contact the owner of the https://G4Skins.com website via:

    2. by email – depending on the type of matter, to the following email addresses:

      1. support@g4skins.com - technical issues, questions regarding the operation of the Website;

      2. partner@g4skins.com - cooperation inquiries;

      3. legal@g4skins.com - legal matters and contact details for authorities or services;

      4. bans@g4skins.com - appeals against account suspensions.

    3. contact form available in the technical support tab – used to report issues related to the functioning of the Website. In the case of contact via the contact form, the Administrator responds 24/7.

  3. These Terms and Conditions are available at all times on the website https://G4Skins.com, in a manner that allows them to be obtained, reproduced, and recorded at any time by printing or saving them on a medium.

  4. Matters relating to the processing of personal data are set out in the privacy policy available at: https://G4Skins.com/privacy-policy .

§2 Definitions
  1. Terms and Conditions - this document setting out the terms and conditions of use of the Website;

  2. Website - the website located at https://G4Skins.com;

  3. Steam - an online service located at steamcommunity.com;

  4. Administrator - OXMIS LTD, HE 467004, Markou Drakou, 69, Mesa Geitonia, 4002, Limassol, Cyprus;

  5. User - a natural person using the Website who is of legal age and, by starting to use the Website, declares and ensures that they meet this condition and have reached the age of majority. The user is responsible for the accuracy of the above statement;

  6. Account - the part of the Service assigned to the User, which they can log into via Steam;

  7. Service – a paid or free service provided electronically on the Website to the User;

  8. Item - a virtual resource with no physical form used in the game Counter Strike 2;

  9. Supplier – a third party through which the Administrator provides Services on the Website, including the payment of Items to the User's Steam account;

  10. Inventory Value – the number of Credits assigned to an Item in the User's inventory at the time of obtaining the Item on the Website;

  11. Status Awaiting Delivery – status indicating temporary unavailability of the Item for withdrawal under the terms and conditions specified in the Inventory Value;

  12. Newsletter – digital content containing commercial information about the Administrator's current activities, including information about new products and promotions available on the Website, sent to the User after they have consented to receive commercial information;

  13. Event points – a virtual resource, also known as gems, which the User can earn and use only during the duration of an Event organized on the Website. Joining an Event is possible after the User has read and accepted the provisions of the Event Rules;

  14. Piggy Bank – a temporary technical balance assigned to the User Account, to which Items transferred as part of Pay by Skins payments are credited, except in cases where the User uses Instant Payment. The Piggy Bank system was introduced to the Service in connection with Steam's rules regarding the exchange of Items;

  15. Instant payment – a form of payment within Pay by Skins, in which Items do not go (or only partially go) to the Piggy Bank, and the User receives Credits immediately after making a payment with Items, provided that the value of the transferred Items does not exceed the currently available Instant Payment limit for a given User. The amount of Credits received depends on:

    1. the amount of the available Instant Payment limit – if the limit is exceeded, the difference goes to the Piggy Bank and

    2. the value of the technical security deposit for the transaction by the Service - if the transaction is not canceled by the User, the value of the security deposit will be automatically transferred to the User's main balance after 8 calendar days.

    The option to use Instant Payment is available only to Users who are not subject to the restrictions referred to in § 4(9) of the Terms and Conditions. Cancellation by the User of a Pay by Skins transaction referred to in § 4(9) results in the loss of the right to use Instant Payment.

§3 Property rights
  1. The Administrator holds the copyright and intellectual property rights to the Website, including its name, internet domain, layout, software, logos, and original content developed by the Administrator (or for which the Administrator holds the appropriate licenses), excluding content and markings to which third parties hold the rights.

  2. This website is not affiliated with Valve Corporation and does not have the rights to use any textures, skins, or other content belonging to Valve Corporation. All rights (including copyrights and trademark rights) to elements related to the game Counter Strike 2, Steam, and names and symbols that may belong to Valve Corporation (or other authorized entities) are reserved by those entities.

  3. Any use of the materials referred to in section 1 above may only take place with the prior consent of the Administrator. Dissemination of these materials without the Administrator's consent shall constitute a violation of copyright and shall result in the obligation to pay appropriate compensation to the Administrator.

§4 Terms of Use
  1. Due to the possibility of purchasing Items on the Website in the form of virtual resources that do not have a physical form used in the game Counter Strike 2, which according to the PEGI classification is intended for people of legal age, the Website may only be used by people of legal age. The Administrator makes available on the Website and encourages users to read the document Parental Control, which lists the currently available ready-made parental control tools that enable monitoring and controlling the activities of minors on the Internet.

  2. Before using the Website, the User is required to read the Terms and Conditions and Privacy Policy, and is also required to confirm that he/she has reached the age of majority in accordance with the provisions of section 3 below. If the User does not accept the provisions of the Terms and Conditions or the Privacy Policy, or has not reached the age of majority, they are obliged to cease using the Website.

  3. Use of the Website Services is permitted only to adults with full legal capacity. Persons who have not reached the age of majority are prohibited from using the Website Services. In order to verify age, the Administrator requires a declaration of age to be submitted, or if the required age is not reached, the person who accessed the Website is obliged to immediately cease using the Website, including canceling their login. Submitting a statement that is inconsistent with the facts (false) constitutes a gross violation of the provisions of the Terms and Conditions. The user bears full responsibility for the accuracy of the statement submitted.

  4. If the Administrator obtains information about the use of the Website by a minor, the Administrator has the right to block all Accounts of such a person due to a gross violation of the provisions of the Terms and Conditions by that person. Upon entering the Website, the User will be informed about the blocking of their Account and about their right to lodge a complaint by appealing against the decision to block the Account via email: bans@g4skins.com. If the complaint is accepted, the Administrator will immediately unblock the Account. If the complaint is not upheld, the Account will be blocked permanently, which also means that the Administrator will terminate the service agreement with immediate effect. The Administrator will consider the complaint within 14 days of its receipt. A person using the Website in the manner described above shall not be entitled to any claims against the Administrator for blocking their Account and terminating the service agreement, except for the right to withdraw credits held by such person on an Account created in violation of the Terms and Conditions. The payment shall be made in the form of Items or, if the conditions specified in § 10 of the Terms and Conditions are met, in the manner specified therein.

  5. In order to use the Website, the User must meet the minimum technical requirements, i.e. have electronic equipment with Internet access and a web browser with Cookies and Java Script enabled. At the same time, the Administrator informs that the performance of the Service depends on the User's computer equipment and Internet connection.

  6. The administrator indicates that it is strictly forbidden to:

    1. using the Website in violation of the rules and regulations set forth in the Terms of Use, including in a manner inconsistent with its intended purpose;

    2. using the Website in a manner inconsistent with generally applicable law, in particular by providing or transmitting content that is prohibited by law, defamatory, insulting, or infringing on the personal rights and other rights of third parties;

    3. exploiting or attempting to exploit in any form any possible errors or loopholes in the Website;

    4. pretending to be another person or entity on the Website;

    5. using the Website in a manner that disrupts its functioning for the Administrator or other Users, in particular by using specific software or devices to breach the security or authentication measures used by systems and networks, sending viruses, overloading, flooding, spamming, or mail bombing;

    6. decrypting, decompiling, disassembling, reverse engineering, or otherwise examining any software or components used to provide the Services;

    7. accessing, manipulating, or using non-public areas of the Website or Service;

    8. downloading data or other content from the Website in order to create or compile, directly or indirectly, in one or more downloads, a collection, compilation, database, catalog, including similar ones, using manual methods, bots, crawlers, or spiders, or in any other way;

    9. using the Website in a manner inconsistent with the terms and conditions under which the devices and technologies necessary for the operation of the Services have been made available to Users.

  7. If the User detects an error or vulnerability in the operation of the Website or a violation of the Terms and Conditions by another User, the User is obliged to immediately report this fact to the Administrator. Error reports can be made in particular via the tab Bug Bounty, and if the report is accepted, the User may receive a reward in accordance with the rules set out in the Bug Bounty Program available on the Website.

  8. In the event of the User exploiting or attempting to exploit errors leading to financial losses for the Website or conducting other activities to the detriment of the Website, the Administrator is entitled to block the User's account. Upon entering the Website, the User will be informed about the blocking of their Account and about their right to lodge a complaint by appealing against the decision to block the Account. If the complaint is accepted, the Administrator will immediately unblock the User's Account. If the complaint is not upheld, the Account will be blocked permanently, which is tantamount to the Administrator terminating the service agreement with immediate effect. The Administrator will consider the complaint within 14 days of receiving it. The User shall not be entitled to any claims against the Administrator in this respect, except for the right to withdraw credits held in the blocked Account. The withdrawal shall take the form of Items or, if the conditions specified in § 10 of the Terms and Conditions are met, in the manner specified therein.

  9. Cancellation by the User of a transaction within the Pay by Skins payment system, in which the Items have been transferred to the Piggy Bank, shall be considered an action by the User to the detriment of the Website, which entitles the Administrator to impose restrictions on the User's Account or to immediately block the User's Account and enter it in the register of accounts violating the provisions of the Terms and Conditions. In the event of restrictions being imposed, they shall be applied cumulatively and shall include:

    1. permanent loss of the ability to use Instant Payment within Pay by Skins – which means that in the case of payments with Items, all transferred Items will be placed in the Piggy Bank for a period of 8 days;

    2. removal of Credits, event points, and Items located in the Inventory from the User Account;

    3. removal all active, unfinished Battles;

    4. blocking the ability to open the daily case for a period of 30 days;

    5. exclusion from the right to receive the Item from the Event Ranking;

    6. removal of the right to use both types of Chickenpass, including Chickenpass Free and Chickenpass Prime;

    7. cancellation of all User coupons.

    Once the User enters the Website, he/she will be informed about the restrictions imposed or the blocking of his/her Account, as well as about the right to lodge a complaint by appealing against the Administrator's decision. If the complaint is accepted, the Administrator will immediately lift the restrictions or unblock the Account. If the complaint is not upheld, the Account will remain restricted, and in the case of a block, it will remain blocked permanently, which also means that the Administrator will terminate the service agreement with immediate effect.

  10. If the Administrator has reasonable grounds to suspect that the User's activity or a specific transaction may violate generally applicable law, violate the provisions of these Terms and Conditions, in particular the provisions concerning security, use of the Website, payment rules, or threaten the security of the Website or other Users, the Administrator may block the User's Account or impose restrictions on the User's use of certain features of the Website until the suspicions have been clarified. The User shall be informed of the imposition of a block or restrictions by means of a message displayed on the Website. In order to clarify the situation, the User should contact the Administrator, in particular at the following e-mail address: bans@g4skins.com, providing the Account identification data required by the Terms and Conditions (including at least a link to the Steam profile or the steamID64 identification number).

  11. Except for cases specified in the Terms and Conditions, in which the Administrator has the right to immediately block the User's Account and terminate the service agreement in the event of a breach of the Terms and Conditions by the User, the Administrator, after a prior unsuccessful request to cease or remove the violations, setting an appropriate deadline, may terminate the contract for the provision of Services with 14 days' notice.

  12. The User may use the Services on the Website 24 hours a day, 7 days a week. The Administrator shall inform about any maintenance work on the Website that hinders the use of the Website in any way on the Website's home page.

  13. As part of the Website, the User may: use the Account, purchase an Item in the Store tab, purchase the opening of a case with an Item, for which experience points (EXPA points) can be obtained, or, in the scope of cases opened during and as part of an Event, obtain event points, use the Exchanger function. Actions, transactions, and operations performed by the User on the Website are final and cannot be withdrawn, canceled, or reversed at the User’s request, unless otherwise expressly provided in the Terms of Service or the Return Policy. This applies in particular to the use of the Website’s features, making transactions using Credits, exchanging Items, opening chests, participating in Battles, using the Exchanger feature, and other actions taken by the User within the Account.

  14. The Website may occasionally organize promotions or other events related to the game Counter Strike 2, the rules and conditions of which will be specified each time on the Website and in the relevant regulations.

  15. The Administrator may post links to third-party websites on the Website. The Administrator has no control over the content of these links. The Administrator shall not be liable for any damage/loss caused by the use of such websites. It is recommended that the User familiarize themselves with the terms and conditions of service of the websites visited via links.

  16. Partners cooperating with the Website as part of their cooperation may receive credits through which they use the Website's functions. In such a case, partners do not make payments or top up their Accounts on their own.

  17. The User is responsible for ensuring the security of their Steam account login details and verifying the correctness of the Website address before each login. The Administrator shall not be liable for any losses incurred by the User, including the loss of Items or funds, resulting in particular from:

    1. the User logging in on a fake website,

    2. sharing login details with third parties,

    3. acceptance of false trade offers generated by third parties using User data obtained without authorization.

  18. Due to the fact that logging into the Website is done via a Steam account, and the Account data on the Website is linked to the User's Steam account, each time you contact the Administrator (in particular via email, contact form, or other communication channel provided by the Website) the User is required to provide data enabling the identification of the Account, i.e. a link to the Steam profile and the steamID64 identification number (a recording showing where the User can download their steamID64 identification number can be found at pod tym linkiem). Applications that do not contain the above information will not be considered.

§5 Account
  1. The Administrator informs that the use of the functionality or Services on the Website requires logging into the Account via a previously created Steam account.

  2. The user may have a maximum of 5 Accounts, but may only use one of them for the following Website functionalities:

    1. Daily case;

    2. Promo codes;

    3. Partner code;

    4. Chickenpass Free.

  3. Logging into the Account is possible only after accepting the Terms and Conditions and Privacy Policy, as well as after the User submits a statement by checking the checkbox confirming that they are of legal age.

  4. Using more than one Account to use the functionalities listed in section 2 above will constitute a material breach of these Terms and Conditions, resulting in a decision to block all User Accounts. Upon entering the Website, the User will be informed about the blocking of their Account and about their right to lodge a complaint by appealing against the decision to block the Account via email: bans@g4skins.com. If the complaint is accepted, the Administrator will immediately unblock the User's Account. If the complaint is not upheld, the Account will be blocked permanently, which is tantamount to the Administrator terminating the service agreement with immediate effect. The Administrator will consider the complaint within 14 days of receiving it. The User shall not be entitled to any claims against the Administrator in this respect, except for the right to withdraw credits held in the blocked Account. The withdrawal shall take the form of Items or, if the conditions specified in § 10 of the Terms and Conditions are met, in the manner specified therein.

  5. The User understands and accepts that logging into the Account is done via Steam. The User declares that they have read the terms and conditions of use of Steam available at the following link: https://store.steampowered.com/ and accepts their content.

  6. The User is responsible for managing and using the Account and is obliged to keep the login details for the Account confidential.

  7. Upon discovering a violation or suspected violation of the confidentiality of your Account login details, the User should use the password recovery function to obtain a new password.

  8. By logging in via Steam, the User does not provide the Administrator with their Steam account login details, and authentication is performed via Steam. At the same time, the User understands and accepts that in connection with logging in and using Steam integration, the Service may receive and process data necessary for the operation of the Account and the functionality of the Service, in particular the Steam ID (steamID64), as well as, depending on the Steam settings and data provided by the User, information about the User's inventory and its value.

  9. The user is responsible for any actions or omissions made using the Account.

  10. The Website distinguishes between three levels of Account security, which determine withdrawal and deposit limits, which then unlock further Services on the Website.

  11. The User has the option to check the current security level of their Account at any time.

  12. The User will automatically receive the first security level after funding their Account with a total amount equivalent to $2, according to the exchange rate applicable on the Website at the time of funding the Account. In order to be able to withdraw Items held in the inventory, the User must obtain the first security level by crediting the Account with the above-mentioned amount for the first time. With the first security level obtained, the User acquires the right to withdraw Items even if their Account balance is lower than the equivalent of $2. Making the withdrawal of Items dependent on obtaining the first security level is intended to verify the User and their actual activity, and to prevent the creation of unrealistic Accounts operated by software (so-called bots). This security level is obligatorily assigned to the User after the above condition is met. The User will not lose the first security level assigned to them; it is permanently assigned to the User's Account, regardless of the amount of credits they have. Failure to make the first deposit to the Account in the above-mentioned amount and obtain the first security level prevents the withdrawal of Items held in the inventory. Subsequent security levels are optional and depend on the User's actions on the Website.

  13. The User is required to enter the correct Trade Link in their Account settings, i.e., the individual trade link assigned to the User's Steam account. Entering the Trade Link is a prerequisite for using selected features of the Website, in particular for topping up the Account via the Pay by Skins method and requesting the withdrawal of Items to the Steam account. If the Trade Link is not entered in the User's Account, it will not be possible to use these features, which is beyond the Administrator's control.

  14. Items may only be withdrawn to the Trade Link assigned to the User's Steam account, which the User used to log in to the Website. It is not permitted to specify a Trade Link belonging to a third party or to a Steam account not associated with the User's Account on the Website. If the User adds a Trade Link to his Account that is not linked to his Steam account, the Administrator has the right to refuse to process the withdrawal or top up the Account.

§6 Price and Payments
  1. The User may top up their Account at any time with a minimum amount of PLN 5.00 or its equivalent according to the exchange rate applicable on the Website at the time of topping up the Account (aktualny kurs w Serwisie), receiving credits that are not real money and are not refundable to the User (except in the case specified in § 10).

  2. Credits enable the User to make transactions on the Website.

  3. During the purchase of credits, the User is required to submit a statement accepting the terms and conditions of the Regulations and the privacy policy, as well as a statement confirming that they are of legal age.

  4. Credits are purchased using the payment methods indicated on the Website, including, among others, payment by card (including Visa, Visa Electron, Mastercard, Mastercard Electronic, Maestro), online transfer, or other electronic payment methods supported by payment operators (including, among others, ZEN, Ecommpay, Simpay), as well as via: BLIK, BLIK Płacę Później, paysafecard, gift cards, including, among others, from Kinguin, or via Pay by Skins (the use of Pay by Skins requires the User to first fill in the correct Trade Link in the Account settings in accordance with § 5 sections 13 and 14). The Administrator reserves that the availability of individual payment methods may change, and the current list of payment methods is indicated each time on the Website during the transaction. The payment operator may charge a commission, which is independent of the Administrator. At the time of purchase, the User is informed about the amount of commission charged by the operator. The User acknowledges and accepts that payments made through payment operators are subject to the terms and conditions and rules specified by those operators. By making a payment, the User confirms that they have read the relevant terms and conditions of the payment operator and agrees to comply with them. After purchasing credits, the User receives a payment confirmation sent to the email address provided during the payment process, if the payment method requires such an email address. For payment methods that do not require an email address (e.g., Pay by Skins, gift cards), payment confirmation is not sent by email.

  5. In the case of the BLIK Pay Later payment method, the User acknowledges and accepts that this is a deferred payment option available in the BLIK system and at the User's bank, provided on the basis of separate terms and conditions of BLIK and the bank, enabling the purchase of credits on the Website. The Website does not provide or determine the terms and conditions of BLIK Pay Later. The possibility of using BLIK Pay Later and its rules result from the terms and conditions of the agreement concluded by the User with the bank and from the terms and conditions of BLIK, over which the Administrator has no influence. The Administrator is not a party to the legal relationship between the User and the provider of BLIK Pay Later, in particular, it does not set limits, does not make decisions on granting financing, does not influence the rules of settlement, and is not responsible for any costs, fees, commissions, interest, repayment dates, or other terms and conditions of this service.

  6. By using BLIK Pay Later, the User declares that they have read the rules of this payment method applicable in the BLIK system and at the User's bank, understand its nature, and undertake to fulfill their obligations arising from the use of this payment method in a timely manner.

  7. Claims and complaints regarding the operation of BLIK Pay Later, including in particular those concerning the granting or refusal of financing, limits, settlements, costs, repayment schedule, account debits, or other activities of the provider of this payment method, shall be addressed by the User directly to the relevant BLIK Pay Later provider.

  8. In the case of purchasing credits via Pay by Skins, each payment made with Items (except in cases where the User uses Instant Payment) is transferred to the Piggy Bank assigned to the User's Account for a period of 8 calendar days. During this period, the User has the right to cancel the transaction:

    1. which will be equivalent to restoring the Items in the Piggy Bank to the User's inventory, and

    2. which will entitle the Administrator to impose restrictions on the User Account or to immediately block the User Account and enter it in the register of accounts violating the provisions of the Terms and Conditions, in accordance with § 4(9) of the Terms and Conditions.

    After the period of 8 calendar days has expired, the User shall not have the right to cancel the transaction, and the funds (credits) from the Piggy Bank shall automatically be credited to the User's main balance.

  9. In order to use Instant Payment, the User must have an active Instant Payment limit, which determines the maximum total value of Items that can be covered by Instant Payment in a given period, with the proviso that the value of the Credits received will be reduced by the value of the technical security of the transaction. The limit is set individually for each User by the Service, in particular on the basis of: the User's transaction history on the Service, the security level of the Account on the Service, the level of the Steam account associated with the User's Account, the frequency and value of previous payments, and activity on the Service. The user can check his current available Instant Payment limit in his Account settings or on the Pay by Skins payment screen.

  10. In the case where the total value of Items within Instant Payment:

    1. is equal to or lower than the limit available to the User – part of this value, after deducting the technical security deposit for the transaction, will be immediately transferred to the User's main balance. The remaining part, constituting the security value, will go to the Piggy Bank and will be transferred to the User's main balance after 8 calendar days, if the transaction is not canceled by the User;

    2. is over than available limit – the top-up amount will be split: (a) the part that fits within the limit (after deducting the technical transaction security) will go straight to the User's main balance as an Instant Payment; (b) the remaining part, as exceeding the limit, together with the value of the technical transaction security, will be transferred to the Piggy Bank.

    The Instant Payment Limit is reduced each time by the amount of the top-up. The limit is automatically renewed every 7 calendar days, which means that after this period, its full value assigned to a given User becomes available again.

  11. By making a payment to the Website, the User declares that the country selected or indicated by the User for VAT settlement purposes is correct and corresponds to their actual place of residence or habitual abode. VAT settlements made by the Administrator are based in particular, but not exclusively, on the accuracy of the above statement by the User, and the Administrator shall not be liable for any tax consequences on the part of the User resulting from providing or selecting an incorrect country for VAT settlement.

  12. The prices of Items on the Website are given using symbols, in particular such as: $, € or zł, as well as other symbols available on the Website.

  13. Item prices are set by Suppliers. In the event of any difference with prices set by Steam, among others, the Supplier's price shall be binding.

  14. When an Item is obtained on the Website, it is assigned to the User's inventory along with its Inventory Value. The Value in Inventory is determined at the time of obtaining the Item based on the Supplier's price and constitutes the only binding value assigned to that Item on the Website, in particular for the purposes of using the Website's functionality relating to that Item.

  15. The User understands and accepts that the Value in the Inventory is not automatically updated, in particular, it does not change simply because the price of the same Item has changed over time at the Supplier or on the market (including the Steam community market). This means that the value of an Item on the Service may differ from current market prices or prices at the Supplier, which is a result of the volatility of the Item market and the Supplier's pricing policies. The User therefore acknowledges that the same Item (with the same name or type) may have a different Inventory Value on the Service for different Users (as well as on different Accounts of the same User) if it was obtained at different times, i.e., when the Supplier's price was different. As a result, at a given time, one User may be able to withdraw such an Item, while another User may have the status of Waiting for delivery for the Item if the Supplier's prices do not allow for withdrawal in accordance with the Value in the Inventory assigned to their Item.

  16. A request to withdraw an Item from inventory to Steam account can only be fulfilled if, at the time of the withdrawal request, the Supplier allows the Item to be purchased on terms that allow the withdrawal to be fulfilled in accordance with the Value in Inventory. If, at the time of the request, the Supplier offers the Item at a price other than the Value in Inventory, the Item will be given the status Pending Delivery, which means that the Item will be temporarily unavailable for withdrawal on the terms resulting from the Value in Inventory.

  17. If the Item is marked as Awaiting Delivery, the User may:

    1. wait for the availability of the Item to change, which is understood as the moment when, according to information from the Supplier, the Item becomes available again on terms corresponding to the Value in the Inventory (i.e., when the Supplier's price allows the use of the function on the Website while maintaining the Value in the Inventory);

    2. exchange the Item within the Exchanger, provided that the exchange is carried out in accordance with the Terms and Conditions and based on the Item's Inventory Value.

  18. Due to the fact that the availability and prices of Items depend on Suppliers and variable market conditions, the Administrator shall not be liable for:

    1. changes in the prices of Items at Suppliers or on the Steam community market, including sudden, significant, or rapid price fluctuations, even those occurring within a short period of time;

    2. differences between the Value in Inventory and the current market prices of Items;

    3. temporary unavailability of the Item marked with the status Awaiting delivery, nor for the duration of such unavailability.

    The User shall not be entitled to any claims against the Administrator in this respect, in particular claims for payment despite the unavailability of the Item, for payment of cash, for compensation, or for compensation for the difference in value.

  19. The User Account provides access to the history of transactions made by the User. The User may view this history at any time via the Website, but without the possibility of downloading it and saving it on a durable medium.

  20. The User Account on the Website is funded exclusively with credits. These credits are used to make transactions and use the services offered by the Website, including the purchase of Items in the Store tab.

  21. Credits are not and will not be treated as real money, fiat currency, or their equivalent. The user acknowledges that the funds deposited are exchanged for virtual credits that can only be used within the Service.

  22. Funds accumulated in the User's account in the form of virtual credits cannot be withdrawn, exchanged for money, or transferred to other accounts.

  23. If it is impossible to transfer Items from the Inventory to the User's Steam account for reasons beyond the control of the Service, in particular due to a VAC ban imposed on the User's Steam account, the User may contact the Administrator in this matter via the contact form located in the technical support tab. After performing the necessary verification, the Administrator may enable the transfer of Items located in the User's Inventory to another Account on the Website indicated by the User. The transfer does not include Items obtained by the User from free boxes available on the Website. Each request is considered individually, and the decision on the applicability of the above solution rests with the Administrator.

  24. The User accepts that any funds credited to the Account in the form of virtual credits are intended solely for the use of the services offered by the Website and cannot be treated as a financial investment. The Administrator shall not be liable for any damage or loss incurred by the User, resulting in particular from improper use of the Website, violation of the provisions of the Terms and Conditions, or misunderstanding of the nature of the services provided on the Website.

§7 Store, Item Sales, Steam Account Withdrawal, Exchanger
  1. On the Website, the User may purchase an available Item in the Store tab. The User makes the purchase transaction using his/her credits. The Item can be searched for using the search engine with advanced filters or by browsing through all pages with available Items.

  2. Each Item has a specified number of credits for which the User can purchase it. In order to make a purchase, the User must have the number of credits necessary to purchase the Item. If the User does not have enough credits to purchase the Item, the User can top up their Account to receive additional credits.

  3. Items obtained by the User as a result of using the Website's functionality are added to the User's Inventory, subject to the cases described in the Terms and Conditions regarding Pay by Skins payments and the possibility of canceling transactions by the User, as well as subject to Items purchased in the Store, which are sent directly to the User's Steam account in accordance with section 5 below. The User may check the contents of their inventory at any time within their Account. The values of Items visible in the Inventory (Inventory Value) are determined and apply in accordance with the rules set out in § 6 of the Terms and Conditions.

  4. The User may sell Items located in the Inventory to the Account balance in the form of Credits, in accordance with the value indicated for a given Item in the inventory (i.e. based on the Value in the Inventory in accordance with § 6 of the Terms and Conditions and in accordance with the rules of availability of Items specified in § 8). Upon the sale of an Item, the User's Inventory is reduced accordingly and the User's Account is credited with the indicated number of Credits. A request to withdraw Items to a Steam account requires the User to complete the Trade Link in the Account settings in accordance with § 5 sections 13-14 of the Terms of Service.The sale of an Item in the Inventory for Credits credited to the Account is final. Once an Item has been sold, the User may not request that the sale be reversed, that the sold Item be returned to the Inventory, that the same Item be returned, that an equivalent Item be provided, or that any other compensation be granted in this regard.

  5. When an Item is purchased in the Store tab, the relevant number of credits is deducted from the User's Account balance, and the Item is sent directly to the User's Steam account via a trade offer. Items purchased in the Store are not added to the User's Inventory on the Website. The User may accept or reject the trade offer on Steam. If the offer is rejected or not accepted on Steam within the specified time, the Item purchased in the Store is not transferred to the User, does not go to the Inventory on the Website, and the purchase transaction is treated as not completed. In such a case, the Administrator shall refund the User the equivalent of the credits collected by crediting the User's Account balance on the Website. The User may use the refunded credits on the Website in accordance with the provisions of the Terms and Conditions.

  6. Items are shipped to the User by an external Supplier, the Website is only an intermediary in the transaction.

  7. The User may request the withdrawal of an Item from their Inventory to their Steam account if the Item is available at the time of the withdrawal request, in accordance with the rules of Item availability specified in § 6 and § 8. Requesting the withdrawal of Items to the Steam account requires the User to complete the Trade Link in the Account settings in accordance with § 5 sections 13 and 14. After the User requests the withdrawal of an Item, the User is informed about the new exchange offer within the Steam account. The User may accept or reject the offer. If the offer is rejected (or not accepted on Steam within the specified time), the Item remains in the User's Inventory and the withdrawal request is considered unfulfilled. Upon acceptance of the exchange, the User's Inventory is reduced by the withdrawn Item. The value of an Item purchased by the User in the Store tab, after it has been paid out to the Steam account, may differ from the value of the same item on the Steam community market, which is independent of the Administrator and for which the Administrator is not responsible. The values of items on the Steam Community Market are determined solely by the users of the Steam Community.

  8. On the Website, the User may use the Exchanger function, which allows them to select up to 20 Items from their Inventory for exchange and then receive a list of available Items that can be obtained in exchange. The use of the Exchanger function is subject to the provisions regarding the Value in the Inventory (§ 6 of the Terms and Conditions) and the rules regarding the availability of Items (§ 8 of the Terms and Conditions). The total value of the Items selected for exchange, calculated based on the Value in the Inventory, must be equal to or higher than the total value of the Items that the User is to receive through the Exchanger. The User may receive 1 to 3 Items in a single exchange. If the total value of the Items selected for exchange is higher than the total value of the Items received, the difference will be refunded to the User in the form of Credits to their Account.

§8 Item Cases
  1. The Website offers Users the opportunity to purchase the opening of a Case with Items, purchase the opening of a Case with Items created by other Users, open an EXP Case once every 6 hours, and open a Daily Case once a day, with experience points or a new Case with Items.

  2. Before purchasing, the contents of the case are made available to the User by the Administrator, along with information on how to obtain the Item.

  3. The administrator does not interfere with the mechanisms responsible for the functionality of the Website, including the mechanism for opening the case by the User.

  4. The Administrator does not guarantee that the value of the case will be greater than or equal to the purchase price of opening the case. The value of the case after opening may be higher or lower than the purchase price of opening the case, which the User understands and accepts.

  5. After opening the case, in addition to the Item, the User may receive experience points that allow them to increase the level of their Account, and may also receive event points for cases opened during and as part of the Event.

  6. Depending on the number of experience points they have, Users reach a specific level within their Account. Levels increase as the number of experience points a User has increases. The User cannot drop to a lower level than the one previously achieved. Upon advancing to a higher level, the User receives keys to EXP boxes. The Website distinguishes between the following types of EXP cases: Rust, Bronze, Silver, Golden, Platinum, Diamond. Depending on the number of levels, the User receives a specific number of keys entitling them to open the EXP box assigned to that level. EXP cases can only be opened once every 6 hours, regardless of the User's level and the type of EXP case unlocked. The Administrator provides a link below to a page containing information in the relevant tabs on: the number of experience points required to reach a specific level, the number of keys assigned to a given type of case and obtained upon reaching a given level:https://g4skins.com/pl/exp-cases.

  7. The Website operates a daily case level system. The Administrator informs Users on the Website about the current number of daily case levels and the rules for assigning levels. The number of levels may change over time. The User may only open the case level that he/she currently has. In order to achieve a higher level, the User should top up his/her Account. The daily case level is calculated based on the sum of top-ups from the last 30 days (taking into account the provisions of the Terms and Conditions regarding Pay by Skins, Instant Payment, and the Piggy Bank system). If the User does not add credits within 30 days of the last addition, the User's level will drop to the first level. Each higher level reduces the time required to open the next case by one hour. At the first level, the User can open a case every 24 hours, while at the 5th level, for example, this time is reduced to 20 hours.

  8. The User may have up to 10 active cases created in an Account at the same time. The User understands and accepts that the value of the Items in the case created by them, as well as the price of the case itself, does not automatically change with the change in the value of the Items. This means that if a given User opens a case at a later date than its creation (e.g., a month later), the Items contained therein will have the same value as at the time of its creation. The price of the case itself also remains unchanged. In the event of a change in the value of the Items in relation to the value of the Items in the case created by the User by at least 10%, the Administrator has the right to disable such a case. A User with the first level of Account security can use the free case creator on the Website. The use of the case creator does not involve any fees or costs. With the help of the case creator, the User can set a commission of 0% to 3%, which they expect to receive each time the case is opened. The commission is calculated based on the price of the case created by the User. The User is informed about the amount of commission earned in the User Cases tab. The User may withdraw the commission to their Account credit balance only when the amount is at least equivalent to 1 dollar, according to the exchange rate applicable on the Website at the time of crediting the Account. No commission is charged to Website partners who receive loans from the Website. Before creating a cases, the Website Administrator informs Users that no commission will be charged if the cases are opened by Website partners.

  9. The Administrator informs the User about the availability of a given Item in terms of the contents of cases and inventory. Each Item is marked with a green or red sign (check mark or cross). A green mark means that the Item is available at the moment and can be withdrawn. A red mark means that the Item is not available and is awaiting delivery. The availability status is updated every 5 minutes, which means that the Item may change its status after this period, which the User understands and accepts (the reasons for changing the status of Items are described in the following provisions and in § 6 of the Terms and Conditions regarding Values in Inventory).

  10. The User understands and accepts that Items are delivered to the User via an external Supplier, and the Website is only a technical intermediary in the transaction and exercises all due diligence to ensure that the transaction proceeds correctly. Therefore, the Administrator cannot guarantee that a given Item will be available at all times and that the Item sent to the User will look the same as presented on the Website. However, the Administrator takes all possible measures and exercises due diligence to ensure the widest possible availability of Items, and to this end, the Administrator cooperates with many Suppliers. The User acknowledges and accepts that the possibility of completing a transaction for a specific Item depends on the current availability of the Item from the Supplier and on whether, at the time of the transaction, the Supplier allows the Item to be obtained on terms that allow for completion in accordance with the Value in the Inventory. If, for reasons beyond the Administrator's control (in particular due to a change in the Supplier's price in relation to the Value in the Inventory, or the Item being unavailable from the Supplier), execution on terms corresponding to the Value in the Inventory is temporarily impossible, the Item shall be given the status “Awaiting delivery,” in accordance with § 6 of the Terms and Conditions. If the Item is unavailable, the Administrator encourages you to contact us via the technical support tab in order to answer your questions.

§9 Contract and Battle
  1. The User may use the Contract feature within the Website, which allows them to exchange between 2 and 10 Items from their inventory for one of the higher-class Items that will be displayed to the User as available for receipt under the Contract. The total value of Items cannot be less than the equivalent of $0.1, according to the exchange rate applicable on the Website.

  2. After selecting Items, the User is provided with information about which Items they can receive in exchange, along with an indication of the chances of obtaining a given Item.

  3. The Administrator does not guarantee that the value of the Item received under the Contract will be greater than or equal to the value of the Items submitted for exchange by the User. The value of the Item received under the Contract may be higher or lower than the value of the Items submitted for exchange, which the User understands and accepts.

  4. The User may use the Battle feature available on the Website. To join a Battle, the User selects an available Battle from the list. In order to join a Battle, the User must have credits corresponding to the total value of the boxes in the Battle.

  5. In addition to joining a given Battle (provided that the condition of having sufficient credits is met), the User may create a public Battle, available to all Users, or a private Battle, available only to Users who have a link to it. A Battle created by the User must have at least one case. All cases available on the Website can be added to the Battle, except for event cases and cases created by Users.

§10 Refund of unused Credits
  1. The Administrator provides for the possibility of refunding the User the funds paid for the purchase of Credits only if all of the following conditions are met:

    1. The User submits a refund request within 14 days of purchasing the Credits, and

    2. until the moment of submitting the request, the User has not used any function on the Website that uses Credits, in particular: Official Cases, Daily Case, User Cases, Battles, Store, Use of event points (Gems Case, Destiny Case, Ranking) and

    3. The purchase of Credits was made using payment methods for which refunds are available, i.e., by payment card (including Visa, Visa Electron, Mastercard, Mastercard Electronic, Maestro), online transfer, payments handled by payment operators (including ZEN, Ecommpay, Simpay), payment via: BLIK. Refunds are not available for purchases made using other payment methods available on the Website, in particular: BLIK Pay Later, SMS, Pay by Skins, paysafecard, and cryptocurrency payments.

  2. Refund requests can be sent to: Markou Drakou, 69, Mesa Geitonia, 4002, Limassol, Cyprus, or via email: legal@g4skins.com, or via the contact form located in the technical support tab.

  3. The refund applies only to new credits, after the purchase of which the User has not used any of the functions specified in section 1(2) above for a period of 14 days from the date of purchase. This means that even if the User had credits in their Account but purchased new credits, they are entitled to a refund within 14 days of purchase for these new credits if they do not use any of the functions specified in section 1(2) above during this period. The User understands and accepts that the use of any function specified above therefore applies each time to the most recent credits (those most recently purchased by the User) and thus results in the loss of the possibility of obtaining a refund for the credits.

  4. The terms and conditions of the Website's Return Policy are described in the Return Policy document, available at: https://G4skins.com/policy-receive. Upon accepting these Terms and Conditions, the user declares that he/she has read and accepts the content of the Return Policy.

§11 Complaints
  1. The Users have the right to lodge a complaint in any case where they believe that their rights related in particular to the use of the Website's functionality have been violated.

  2. Complaints should be sent to the following address – complaint statements: Markou Drakou, 69, Mesa Geitonia, 4002, Limassol, Cyprus, or to the appropriate e-mail address indicated in § 1(2)(2) of the Terms and Conditions, depending on the nature of the matter.

  3. As part of the complaint, the User is required to send a link to their Steam profile and their steamID64 identification number (a video showing where the User can find their steamID64 identification number can be found pod tym linkiem), as well as a description of the reported problem enabling its verification. Failure to provide the above information will result in the complaint not being considered. The Administrator may also request the User to provide additional information or documents necessary to consider the complaint, in particular to confirm that the complaint concerns the User's Account and that the User is the person authorized to submit it, as well as to verify the transaction (e.g., payment confirmations, transaction IDs, confirmations from the payment operator). The User is obliged to provide such information or documents if they are necessary to consider the complaint. The Administrator processes the data provided only to the extent necessary to consider the complaint, in accordance with the Privacy Policy and personal data protection regulations.

  4. The Administrator undertakes to consider complaints within 14 days.

§12 Customer Support
  1. In order to quickly respond to Users' questions regarding the use of the Website's services, the Administrator provides a contact form in the technical support tab of the Website, through which the User can send questions regarding the operation of the Website and the services provided, as well as report any problems encountered while using the Website.

  2. Requests via the contact form can be submitted 24/7. The Administrator responds 24/7. In the case of email correspondence with the User, the Administrator responds only to the User's email address used for the last Account top-up transaction made on the Website.

§13 Actions taken to prevent the use of services provided for money laundering, terrorist financing, fraud, tax crimes, and other crimes
  1. In order to prevent the use of the Website for criminal activities, including reducing the risk of money laundering, terrorist financing, fraud, tax crimes, as well as for fiscal purposes, solutions are introduced that enable monitoring, identification, and taking appropriate action against criminal activities while using the Website's services.

  2. In reference to the above, these Terms and Conditions also refer to the policy developed "Polityka przeciwdziałania przestępstwom" to inform Website Users about the purposes of the actions taken and the solutions applied. The User agrees to comply with the rules set out in this policy.

  3. By accepting these Terms and Conditions, the Website User declares that he/she understands the risk of using the virtual resources and functionalities of the Website for criminal purposes, and therefore expresses his/her willingness to cooperate in counteracting crimes, consents to the Administrator obtaining information, data, and documents from him/her, and undertakes to provide them to the Administrator so that the following can be done:

    1. User identification consisting in determining the User's data, including first name, last name, identification number, citizenship, date and place of birth, and place of residence;

    2. Identification of the User's beneficial owners, in a situation where the User acts on behalf of third parties or involves the assets of other entities in the Website. In this case, the Administrator may identify and verify the beneficial owners on whose behalf the User acts;

    3. User verification consisting of confirming the User's identity, including confirmation of the User's identified data;

    4. Assessments of the relationship with the User, including determining the value of current or anticipated turnover of Items, typical behavior and transfer of assets by the User, and typical patterns of use of the Website;

    5. Analysis of the Website User's behavior in terms of unusual circumstances, including those contrary to the findings made in relation to point 4 above, as well as analysis of the User's activity from the perspective of the rationality of their behavior (e.g., whether the user deliberately enters into transactions that are economically disadvantageous to them), analysis of the User's resources in relation to their economic situation;

    6. In reasonable cases, when the User's activity may raise suspicion of using the Website for criminal purposes, the Administrator may request documents confirming the source of the assets involved in the User's activity on the Website, including for the purpose of analyzing the User's behavior;

    7. Determining the User's presence on sanctions lists and linking the User's assets to the circumvention of sanctions policy, as well as identifying persons with PEP/RCA status (politically exposed persons and entities associated with them);

    8. Updating data, information, and documents concerning the User and their activity on the Website. In the case of Users identified as high risk, updates are performed more frequently, at least once a year.

  4. As part of the above consent, the User allows the processing of their personal data for purposes related to crime prevention and allows the collection, processing, and storage of their data by the Administrator or trusted entities, using the samsub website software (https:// sumsub.com/) or by means of verification conducted via e-mail correspondence (in particular by sending the required information or documents to the address indicated by the Administrator). The choice of the method, scope, and channel of verification is solely up to the Administrator, and the User is not entitled to request verification in a specific form.

  5. The administrator will use the collected data, information, and documents to perform analyses concerning a given User, including possible links between the User's activity on the Website and criminal activity.

  6. The User agrees to use the functionality of the Website and trade in Items in a reliable manner, and in particular agrees not to:

    1. trying to hide your identity, using outdated, fake, or someone else's documents;

    2. acting on behalf of and for third parties or using the economic resources of such entities, both with their consent and in situations where such consent has not been given;

    3. practices involving the use of third-party payment methods or forms and refusal to prove ownership of a given form of payment or payment instruments (e.g., use of a debit or credit card, third-party payment account);

    4. using technical faults of the Website;

    5. the practice of creating and using multiple Accounts by a single User, in a situation where this is not justified by factors related to the User in question (without a clear reason);

    6. violations of the Terms of Use, policies, and procedures governing the operation of the Website;

    7. the introduction of assets that do not have a legal source or translation into the User's income;

    8. using Items as a means of investing assets of criminal origin and as a means of storing and transferring value (trading in Items within the Service is for entertainment purposes only and is not intended to create alternative means of storing and transferring value);

    9. the practice of removing Items immediately after receiving them, which may indicate that the Website is being used as a tool for converting and transferring assets, and that the User's activity is not aimed solely at satisfying entertainment needs.

  7. In the event of a reasonable suspicion or discovery that the User's activity falls within the above scenarios, violates generally applicable law or the internal regulations of the Website, the User declares that they are aware that the Administrator may:

    1. Refuse to execute or suspend the processing of specific transactions or all transactions;

    2. Block or restrict access to the User Account, Items owned, Account balance, and tools enabling the trading or removal of Items from the Website;

    3. Initiate proceedings related to determining the User's situation, including by updating the User's KYC, obtaining additional explanations and documents;

    4. Refuse to provide Services delivered through the Website;

    5. Notify the relevant authorities, including law Enforcement Authorities, of a reasonable suspicion that a crime has been committed by the User, based on credible evidence that gives rise to such suspicion.

  8. In situations related to refusal to perform, suspension of a transaction, blocking, restriction of access to the Account, Items owned, Account balance, and tools enabling trading or removal of Items from the service, in order to proceed with the removal of restrictions, the User is obliged to provide the data, information, and documents indicated by the Administrator.

  9. After the Website User has provided the requested data, information, and documents, the Administrator assesses the submitted materials in terms of their completeness and makes decisions regarding further actions to be taken in relation to the User, which may include:

    1. Removal of restrictions on the use of the Account and Items;

    2. Refusal to continue providing Services with the transfer of held values and Items to the User;

    3. Notification of the relevant government authorities about the disclosed crime risk.

  10. If the requested data, information, and documents are not provided, the Administrator shall seek to terminate the process of initiating a business relationship, refuse to establish cooperation, or terminate the existing legal relationship without restoring the User's ability to use the Website's services, including on a temporary basis. In such a case, the Administrator shall consider whether the failure to provide the requested information, data, and documents constitutes grounds for notifying the relevant authorities. If no grounds for notification are identified, the Administrator shall transfer the values and Items in its possession to the User.

  11. The Parties agree that in the event of a reasonable suspicion that the User's activity may be criminal in nature, violates generally applicable law or the internal regulations of the Website, including adopted policies, the Administrator is entitled to terminate the process of establishing a business relationship, refuse to establish cooperation, or immediately terminate the existing legal relationship without restoring the User's ability to use the Services, including temporarily.

  12. The User declares that they are aware that the Administrator may retain the values received from the User and the Items in their possession until appropriate instructions are given by law enforcement or government authorities.

  13. If the User detects transactions that may indicate a connection with money laundering, terrorist financing, fraud, tax crimes, or other crimes, reports should be sent to the following email address: legal@g4skins.com.

  14. The administrator shall not be liable or bear any economic risk for actions taken to ensure compliance with generally applicable laws on combating money laundering, terrorist financing, fraud, tax crimes, and other crimes, and for supporting public administration and law enforcement authorities in this regard.

  15. The Administrator shall not be liable for any damage incurred by the User as a result of performing the above activities, and the User declares that they are aware of the purpose of the Administrator's actions and expresses their willingness to cooperate with the Administrator in this regard, including by actively providing the necessary materials, and waives all claims against the Administrator in connection with the performance of the above obligations.

§14 Affiliate program
  1. The User may participate in the Affiliate Program available on the Website. The Program allows the User to invite other Users to use the Website via a unique referral link (Reflink or affiliate code) assigned to the User, available in the Affiliate Program tab. Participation in the Affiliate Program is voluntary.

  2. With the exception of paragraph 3 below, a User whose Reflink has been used in a transaction made by another User on the Website shall receive credits amounting to 3% of the value of that transaction, with the proviso that in the case of payment by the User who used the Reflink via the Pay by Skins method, the rules set out in the Terms and Conditions shall apply, in particular those concerning the Piggy Bank, Instant Payment, and the possibility of canceling a transaction. After obtaining the minimum amount of credits specified on the Website, the User may withdraw the accumulated virtual funds to their Account.

  3. Credits are granted only if the User to whom the Reflink has been made available has the first level of security referred to in § 5(12). The User may only use the Reflink assigned to one User. The User may change the User to whom they are assigned and whose partner code they use at any time. The User may not use the partner codes of two or more Users at the same time.

  4. The User to whom Reflink has been made available receives credits calculated as a percentage of the value of the Account top-up transaction, in accordance with the current referral program rate indicated on the Website, with the proviso that in the case of payments made by that User via the Pay by Skins method, the rules set out in the Terms and Conditions apply, in particular those concerning the Piggy Bank, Instant Payment, and the possibility of canceling a transaction. Additionally, if the User has not used any Reflink before, only on the first use will the User receive a one-time free Mil-Spec case.

  5. The administrator indicates that it is strictly forbidden to:

    1. usharing of the affiliate code by the User on social media platforms g4skins, except for places designated for this purpose and indicated by the Administrator (e.g., dedicated self-promotion channels);

    2. changing the name of the affiliate code without obtaining the prior consent of the Administrator, including, in particular, creating a promotional code referring to a well-known organization or person. To change the name of the affiliate code, please contact Customer Support;

    3. the User's use of the affiliate code within the accounts held by that User, in accordance with § 5(2)(3).

  6. In the case of a violation by the User of the rules of participation in the Affiliate Program, the User shall not be entitled to receive credits, and the Administrator shall have the right to reset the credits obtained by the User under the Affiliate Program. In addition, the Administrator shall have the rights specified in § 4(10).

§15 Concluding provisions
  1. The Administrator reserves the right to modify the Terms and Conditions at any time. The User will be informed of any significant changes to the Terms and Conditions via information on the Website's home page or by sending an email to the address provided by the User. Continued use of the Website after the changes come into effect constitutes acceptance of the amended Terms and Conditions. If the User does not accept the changes, they should discontinue use of the Website.

  2.
